On Saturday, September 6, 2025, at 1:40 am, Turlock Police responded to an occupied suspicious vehicle at Jack in the Box in the 1900 block of Lander Ave.
The caller reported a man nodding off in the drive-through line and was concerned about him driving off. The man eventually completely fell asleep at the drive-through window.
When officers arrived on scene, they located the vehicle running at the window with Juan Franco, 46, of Delhi, still passed out behind the wheel. Officer Rocha used his patrol vehicle to block Franco’s vehicle before waking him up. While speaking with Franco, Officer Rocha noticed that he displayed objective symptoms of being under the influence.
Franco was removed from his vehicle and detained in handcuffs, while Officer Conrad moved Franco’s vehicle out of the drive-through so customers could continue to use it. Officer Rocha interviewed Franco, who stated that he wasn’t driving; his friend was. Franco’s friend had allegedly vanished, and then he somehow ended up asleep in the driver’s seat.
Officer Rocha administered the horizontal gaze nystagmus test and determined Franco was under the influence of alcohol, arresting him. Officer Rocha then transported Franco to Doctors Medical Center, where blood was forcefully drawn after a search warrant was obtained.
Franco was then booked into the Stanislaus County Public Safety Center for driving under the influence of alcohol and driving with a blood alcohol content of 0.08% or greater.
Additionally, Franco’s vehicle was towed.
